Liability Waiver for Habitat Wellness Facilities Use

Please read this waiver carefully before using the facilities and services at Habitat Wellness ("Habitat".)

1. Assumption of Risk and Release of Liability:

By using the facilities and services of the Habitat, you agree to the following:

  • Acknowledgement of Risks: You acknowledge that there are inherent risks associated with using Habitat including without limitation:

    • Hot and cold temperatures

    • Slippery and uneven surfaces

    • Potential exposure to natural elements

    • The presence of insects and wild animals in outdoor areas 

  • Assumption of Responsibility: You assume all risk associated with your use of Habitat arising in any way, including without limitation negligence, gross negligence, breach of contract, or breach of any statutory or other duty of care on the part of Habitat Wellness Inc., the owners of the freehold or leasehold title of the lands within and comprising the Habitat and each of their respective employees, owners, affiliates, members, agents, successors and assigns (collectively, “Habitat”), .

Release of Liability: You hereby release and waive any and all liability and claims you may have against Habitat for any death, injury, loss, damage or expense suffered in connection with your use Habitat arising in any way, due to any cause whatsoever, including without limitation negligence, gross negligence, breach of contract, or breach of any statutory or other duty of care on the part of Habitat.

2. Your Health and Medical Conditions:

  • Health Representation: You represent and warrant that you are in good health and physically capable of using the facilities without risk of harm to yourself.

  • Non-Medical Staff: You acknowledge that the staff are not medical professionals and cannot diagnose or treat any health conditions.

  • Consult a Doctor: You agree to discuss any health concerns you may have with a healthcare professional before using the facilities.

Stoppage for Health Concerns: If you experience any health-related symptoms during your visit, you agree to stop using the facilities and inform personnel immediately.

3. Use Guidelines:

  • Self-Assessment: It is your responsibility to assess the hazards presented by your use of the facilities and services.

  • Time Management: You are solely responsible for managing your time in the sauna and cold tub and avoiding overexertion. Maximum time in the sauna should not exceed 15 minutes and 3 minutes in the cold tubs.

  • Hydration: Stay hydrated by drinking plenty of water and electrolytes before, during, and after your experience.

  • Temperature Transitions and Gradual Cooling:  Avoid drastic temperature changes. Cool down slowly after your sauna session and avoid jumping directly into cold water. Always shower after the sauna before entering cold water for sanitary reasons and to prepare for the temperature transition.

Safety: The sauna environment is very hot. Be cautious of the hot rocks and stove. Avoid touching them directly.

4. Contradictions:

*Do not use Habitat if you have any of the following medical conditions:

  • Cardiovascular conditions: Heart disease, high blood pressure, arrhythmia (irregular heartbeat), angina, recent heart attack, or stroke.

  • Respiratory conditions: Uncontrolled asthma, severe allergies, or recent surgery.

  • Neurological conditions: Epilepsy, seizures, migraines, or uncontrolled fainting.

  • Pregnant or breastfeeding.

  • Diabetes: If not well-controlled.

  • Skin conditions: Open wounds, rashes, infections, or severe eczema.

  • Fever or illness.

  • Cancer: Consult with your doctor before using the spa circuit, especially if you are undergoing treatment.

  • Mental health conditions: If you have a condition that may be worsened by extreme temperatures or stress.

Taking medications: Consult with your doctor if you are taking medications that may be affected by heat exposure or cold immersion.

5. Additional Terms:

  • Damage Responsibility: You are responsible for any damages caused to the facilities by your misuse.

  • Footwear: You are required to wear proper footwear (i.e., sandals) in all outdoor areas.

  • Right to Refuse Service: Habitat reserves the right to refuse service to anyone for any reason.


I acknowledge that using Habitat, equipment, programs, and treatments may involve inherent risks that could lead to personal injury. This includes potential injuries arising from the negligence of others.


I understand that I am ultimately responsible for my own health and well-being. The Habitat staff, including associates and technicians, are not medical professionals and cannot diagnose or treat specific health concerns.


I agree to disclose any existing health conditions I may have before participating in any program or treatment. If I experience any health-related symptoms during my visit, I will immediately stop my participation and inform Habitat personnel.
